With more than 24 years of experience, Lynn Stewart focuses on general civil litigation with an emphasis on contractual disputes, construction and employment law. She has significant experience in environmental cases involving siltation and water runoff. experience
- Assisted landowners, developers and homeowner associations, through litigation and negotiation, achieve long term successful resolution of stormwater management and siltation problems.
- Represented downstream homeowners in a nuisance and trespass water runoff case which, on appeal, reiterated longstanding Georgia law regarding liability of an upper landowner for damages to a downstream landowner caused by water runoff and siltation and imposition of punitive damages and attorney fees.
- Represented several contractors and design professionals in contractual disputes with public and private owners involving issues such as breach of contract, negligence, payment and performance bonds, pay when paid clauses, enforceability of arbitration provisions, bidder qualifications and performance of work.
- Represented an owner during claim resolution involving a retaining wall failure for breach of contract, negligence and professional malpractice.
- Represented both individuals and companies in successful resolution of cases in various federal and state forums involving employment related claims such as age discrimination, race, sex and disability.
