Contractor Representation and Construction Litigation

Schreeder, Wheeler & Flint represents owners, engineers, general contractors, specialty contractors, and subcontractors in a variety of construction matters. Above all, our attorneys assist clients in managing the myriad legal aspects of private and public construction projects, including residential, commercial and governmental contracting.

More specifically, we routinely represent clients for purposes of drafting contracts, easements and licensing agreements; assisting with pre-bid qualification issues, insurance and bonding considerations, bid protests, contract interpretation, construction schedule disputes, time extensions, change order requests, and contractual warranties; advising as to governmental regulation compliance in environmental and safety areas such as OSHA, environmental regulation, and stormwater management issues; assisting with bidding and licensing disputes and successfully managing construction workers through compliance with governmental contract and labor law obligations; and enforcing contractual obligations through litigation (including defending or asserting lien rights), payment and performance bond claims, warranty claims, contribution and indemnity claims, and bankruptcy issues involving contractors.

In the field of construction litigation, our attorneys have represented general contractors and subcontractors seeking claims recovery due to issues such as differing site conditions, removal from pre-qualified bidder lists, delay claims, acceleration issues, payment and performance bond claims, and liens and warranty claims. The firm has also handled exculpatory clause issues, considered the enforceability of arbitration clauses, and managed contract changes and implied contractual obligations. Recently, our attorneys represented owners in claims against design professionals and general and specialty contractors in recovering damages for a retaining wall failure, defective plans and specifications, defects in performance, and warranty claims, and also represented engineering professionals in asserting and defending claims of breach of contract, fraud, and promissory estoppel.
