Eminent Domain

Schreeder, Wheeler & Flint represents a variety of clients in eminent domain actions brought by governmental and quasi-governmental entities. Our clients include individual property owners, real estate developers, business owners, and the outdoor advertising industry. Our approach seeks to obtain the most advantageous result for our clients, whether in maximizing the compensation or other relief that they receive, challenging the right of the government to acquire the affected property, or working with the agency or entity at issue to develop a more advantageous public project for all affected parties. In addition, we seek to ensure our clients' ability to obtain the most favorable tax treatment possible, in order to maximize the value of the results that we obtain.

Whether you face a simple road widening project or a government-sponsored redevelopment project, we have the experience to assist you in fully protecting and preserving your valuable property rights.

Our eminent domain attorneys have earned a well-deserved reputation for excellence in representing clients' interests and obtaining effective and innovative results. For instance, the firm recently successfully negotiated a $26,000,000 settlement of a threatened condemnation by a local governmental agency that resulted in a bifurcated sale to both the local government and The Trust for Public Land. Our attorneys also effectively litigated a condemnation action brought to install an injector sewer line across property located within the Chattahoochee River Protection Area, resulting in a final judgment more than ten times greater than the government's original offer. The firm also negotiated the relocation of legal non-conforming outdoor advertising signs by the joint cooperation of both the local government and the Georgia Department of Transportation that resulted in benefits to all affected parties and that otherwise would have been prohibited by applicable local ordinances.

Our years of experience, coupled with our knowledge and relationships with various condemning authorities, uniquely position Schreeder, Wheeler & Flint to assist our clients in regard to any eminent domain proceeding.
