Contractor Representation and Construction Litigation
SWF represents owners, engineers, general contractors and specialty contractors in a variety of construction matters, which include:

  • Managing the myriad legal aspects of private and public construction projects including residential, commercial and governmental contracting.
  • Drafting contracts, easements and licensing agreements.
  • Assisting with pre-bid qualification issues, insurance and bonding considerations, bid protests, contract interpretation, construction schedule disputes, time extensions, change order requests and contractual warranties.
  • Counseling owners and contractors as to governmental regulation compliance in environmental and safety areas such as OSHA, environmental regulation and storm-water management issues.
  • Helping owners and contractors with bidding and licensing disputes and successfully managing workers in the construction industry through compliance with governmental contract and labor law obligations.
  • Enforcing contractual obligations through litigation or arbitration (including defending or asserting lien rights), payment and performance bond claims, warranty claims, contribution and indemnity claims and bankruptcy issues involving contractors.

Experience
Our attorneys have successfully:

  • Represented general contractors and subcontractors seeking claims recovery due to issues such as differing site conditions, removal from pre-qualified bidders lists, delay claims, acceleration issues, promissory estoppels, payment and performance bond claims, liens and warranty claims. Handled exculpatory clause issues, enforceability of arbitration clauses, contract changes and implied contractual obligations.
  • Represented owners in claims against design professionals and general and specialty contractors in recovering damages for retaining wall failure, defective plans and specifications, defects in performance and warranty claims.
  • Represented engineering professionals in asserting and defending claims of breach of contract, fraud and promissory estoppels.
