Eminent Domain
We represent a variety of private property owners in regard to eminent domain actions brought by governmental and quasi-governmental entities. SWF clients include individual property owners, real estate developers, business owners, and the outdoor advertising industry. Experience
Our experience includes:

  • The successful negotiation of a $26,000,000 settlement of a threatened condemnation by a local governmental agency, which resulted in a bifurcated sale to both the local government and The Trust for Public Land.
  • The effective litigation of a condemnation action brought to install an injector sewer line across property located within the Chattahoochee River Protection Area, resulting in a final judgment more than ten (10) times greater than the government's original offer.
  • The negotiated relocation of legal non-conforming outdoor advertising signs by the joint cooperation of both the local government and Georgia Department of Transportation that resulted in benefits to all affected parties, which otherwise would have been prohibited by applicable local ordinances.
  • The successful litigation of a road widening condemnation which resulted in the elimination of feasible development of the remainder of our client's property.
