John has more than thirty five years of business litigation and Chapter 11 bankruptcy experience in state and federal courts around the United States. His practice includes representing parties in debt restructuring and lender liability cases as well as property owners in the sale, acquisition and financing of commercial real estate and landfills.
John is licensed to practice in the State of Georgia and is admitted to the bars of the United States Supreme Court, the United States Courts of Appeals for the First, Second, Third, Seventh and Eleventh Circuits and the United States Tax Court.
Obtained summary judgment for a prominent Atlanta real estate developer in enforcing an agreement to release him and his affiliates from over $200,000,000 in bank debt.
Successfully tried a case to jury verdict ratifying the buy out of a limited partner by the general partner in a dispute involving a $130,000,000 apartment project.
Successfully defended numerous borrowers in fraudulent transfer actions and established new precedent in Georgia reversed only by legislative action.
Represented clients in the disposition of landfills, acquisition of property for development of a landfill and litigation with regulatory authorities over permitting issues.
Represented multiple clients in acquiring portfolios of real estate properties and loans.
Represented multiple clients in acquiring, selling and financing hotel, apartment and warehouse properties.
Represented Chapter 7 Trustees in avoidance actions to recover millions of dollars paid to shareholders as part of leveraged buyouts which precipitated the bankruptcy filings.
Represented retired pilots in the Chapter 11 of Delta Airlines and was the first to obtain a separate committee for retired pilots in any airline bankruptcy.
Represented the Official Partners’ Committee consisting of several hundred partners of the accounting and consulting firm of Pannell, Kerr and Foster.
Represented creditors and debtors in multiple Chapter 11 case establishing precedent on the amount of attorney’s fees allowable in Georgia bankruptcy cases.
